Heard Mr.B.S.Das, learned counsel for the petitioner and Ms.P.Naidu, learned counsel representing Commissioner of Endowments, Orissa, Bhubaneswar.

According to Mr.Das the petitioner is aggrieved by nonrefund of earnest money of Rs.1,00,000/- deposited in connection with the auction held on 21.1.2020 for sale of Kouda Prasad within the premises of Shree Radha Kishore Jew and Deities (opposite party No.3) situated at Nilagiri in the district of Balasore. He further submits that though the petitioner has filed a representation before the Commissioner of Endowments, Odisha, Bhubaneswar (opposite party no.1) on 15.6.2020 under Annexure-6 for return of the E.M.D. which was sent through speed post on the same date however till date no decision has been taken on the same. In such background, he prays that a direction be issued to opposite party No.1 to take a decision on the above noted representation of the petitioner within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court
// 2 // directs the Commissioner of Endowments, Odisha, Bhubaneswar (opposite party no.1) to take a decision on the above noted representation of the petitioner in accordance with law within a period of eight weeks from the date of production of certified copy of this order after giving an opportunity of hearing to the petitioner and opposite party Nos. 3 and 4 and communicate the result of such exercise to the petitioner. 4.
The writ petition is accordingly disposed of. 5.
Urgent certified copy of the order be granted on proper application.
