This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Central Government Counsel.

The Petitioner has filed the present writ application with the following prayer:

"In the light of the aforesaid facts and circumstances, it is humbly prayed that the Hon'ble Court may graciously please to issue RULE OF NISI admitting the writ petition and issue notice to the Opposite Parties taking into consideration the facts and circumstances of the case and pass appropriate direction/directions by issuing Writ of Mandamus and directing the Opposite Parties to release the pending dues of the Petitioner in the form of pension and to provide the arrears with interest.

And pass any other order/orders as would be deem fit and proper as facts and circumstances of the case." 4.

In course of hearing of the writ application, learned counsel for the Petitioner submits that the Petitioner has submitted a detailed representation before the Col.Record, Artiillery Record, Nashik, Road Camp, Nashik, Maharashtra, Opposite Party No.5 on

// 2 // 13.03.2022 under Annexuyre-8. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.3 to consider the case of the Petitioner and take appropriate action to release the pending dues of the Petitioner within a stipulated period of time. 5.

Learned Central Government Counsel, appearing for the Opposite Parties submits that he has no objection if appropriate direction is given to Opposite Party No.3 to consider the case of the Petitioner in accordance with law within a stipulated period. 6.

Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party no.3 to consider the case of the Petitioner in accordance with law within a period of six weeks from the date of production of certified copy of this order. The Opposite Party No.3 shall do well to consider the case of the Petitioner and take all possible steps to release the pending dues of the Petitioner in accordance with law without any further delay. 7.

With the aforesaid observation, the writ application stands disposed of.
