Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

Petitioner is in custody since 28.03.2022 in connection with Cyber Crime & Economic P.S. Case No.1 of 2021 corresponding to C.T. Case No. 1 of 2022 pending in the Court of learned SDJM, Balasore for the alleged commission of offence under Sections 465/468/419/420/467/471 of IPC read with sections 66(C)/67(D) of I.T. Act.

The prosecution allegation is that the husband of the informant gave out his bank details to a person over telephone, who impersonated as the staff of IndusInd Bank Customer Care and, thereafter, the amount kept in two fixed deposits accounts, were withdrawn without their notice. In so far as the petitioner is
concerned, the only allegation is that he was involved in selling fake Sim cards using which other accused persons are said to have committed the alleged offence.

Considering the submissions as above, the materials on record, and the fact that there is no acceptable material or evidence to show that the petitioner was in any manner involved in the alleged occurrence, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail. 6.
BLAPL is accordingly disposed of.
