This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the record.

The present writ petition has been filed by the petitioner with the following prayers:
"Under the aforesaid facts and circumstances of the case, it is therefore, prayed that this Hon'ble Court may graciously be pleased to issue a writ of mandamus or any other appropriate writ/writs by directing the opp.parties to issue order of appointment in may favour taking into consideration the notification under Annexure-1 and the vacancies available.
Or pass such other order/orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

It is submitted by learned counsel for the Petitioner that the petitioner was initially appointed as Medical Officer vide notification dated 03.06.2021, however, the petitioner could not join in the service within the time stipulated due to suffering of the petitioner from COVID-19 and the petitioner submitted an application dated 09.04.2021 seeking more time to join in her service. However, the authorities have not taken any decision on her application. Even though the petitioner was directed to join at Jarbanga, Sambalpur within a period of seven days. However, till date no decision has been received from the Government so far as the present petitioner is concerned with regard to extension of time for joining as Medical Officer. While the matter stood thus, the petitioner has approached the Additional Chief Secretary to Government, Health and Family Welfare Department, Bhubaneswar, which is also pending for consideration.

Learned counsel appearing for the State submits that he has no objection, if a direction is given to the authorities to consider the grievance petition of the petitioner in accordance with law within a stipulated period of time.

Considering the rival contentions made by the respective parties, the limited nature of grievance involved in the present writ petition, this Court disposes of the writ petition at the stage of admission with a direction to the Additional Chief Secretary to Government, Health and Family Welfare Department-Opposite Party No.1 to consider the representation of the Petitioner dated 31.12.2021 under Annexure-7 in accordance with law within a period of six weeks from the date of production of certified copy of this order. Further it is directed that keeping in view the petitioner
// 3 // was suffering from COVID-19 and in the event, the petitioner seeks for personal hearing, the same shall be provided in the interest of justice by the Opposite Party No.1 before passing final order as directed hereinabove. It is needless to mention here that the representation of the petitioner shall be considered and disposed of by passing a speaking and reasoned order on the same. Any decision taken on the same shall be communicated to the petitioner within a period of ten days thereafter.

With the aforesaid observation/direction, the writ petition is disposed of.
Urgent certified copy of this order be granted on proper application.
