This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 30.03.2022 in connection with Sahadevkhunta P.S. Case No.50 of 2022 corresponding to C.T. Case No. 167 of 2022 pending in the Court of learned SDJM(T), Balasore for the alleged commission of offence under Sections 395/397 of IPC.

The allegation is that two persons snatched away the vanity bag held by the victim which had cash of Rs.3,20,000/-. In so far as the present petitioner is concerned, it is alleged that he along with another person was following the other two culprits by the motorcycle who committed the offence.

Considering the submissions, the materials on record, which

do not show any overt act committed by the present petitioner, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.
