Heard the submission of learned counsel appearing for the Order No.

petitioners.

Undisputedly, the Civil Miscellaneous Petition involves a challenge of a judgment in the finality of the C.S.No.118/2011-1 (Title Suit No.356/2002-1) being disposed of on 29.1.2013. This is a matter in clear abuse of process of Court and in clear wrong advise by the counsel to the party concerned. As the Civil Miscellaneous Petition is not entertainable, for the involvement of the order, the Civil Miscellaneous Petition stands disposed of however with exemplary cost of Rs.10,000/- (Rupees ten thousand only) to be deposited in the Office of Collector, Balasore under State Red Cross Fund within a period of one month hence, failure of which it shall be deemed to be a recovery under the O.P.D.R. Act.
