This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioners are seeking pre-arrest bail in connection with Pattamundai P.S. Case No. 115 of 2022 corresponding to G.R. Case No. 115 of 2022, pending on the file of the learned JMFC, Pattamundai for commission of offence under Sections 294/ 323/ 354/325/379/506/34 of the I.P.C.

Perused the case diary and the statement of one Runi @ Rani Jena.

Considering the same this Court is not inclined to exercise its jurisdiction under Section 438 Cr.P.C. vis-à-vis petitioner No.5. The ABLAPL accordingly stands dismissed qua the Petitioner No.5.

So far as Petitioner Nos. 1 to 4 and 6 to 8 are concerned, taking into account the nature of allegations and role ascribed to
them, this Court directs that on surrendering within three weeks hence and moving for bail, they shall be released on bail by the learned court in seisin over the matter on such terms and conditions as deemed just and proper.

Accordingly, the ABLAPL is disposed of.
