It is alleged that in spite of clear direction of this Court, the execution proceeding no.03 of 2006 pending on the file of Civil Judge (Junior Division), Dharmagarh has not been concluded. This Court finds there was some genuine difficulty like Corona havoc preventing the courts from having normal functioning and the secondly Bar Associations are also busy in putting requisitions after requisitions in pressuring the trial court nit undertaking the hearing exercise. 2.

Keeping this in view, this Court observes, provided there is no resolution of the Bar Association concerned not to undertake hearing exercise all out attempt may be taken to close the aforesaid execution proceeding at least within a period of three months from the date of communication of this order. Keeping in view the request of the decree holder, this Court observes, there should not be any adjournment either at the instance of the decree holder of counsel appearing for the decree holder.

The Civil Miscellaneous Petition stands disposed of with the observation made hereinabove.
