Heard Mr.S.K.Mahanty, learned counsel for the petitioner and Mr.H.M.Dhal, learned Addl. Government Advocate. 2.

According to Mr.Mahanty the petitioner is aggrieved by inaction of the authorities in paying the compensation under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and rules made there under though his land has been acquired by the authorities. He further submits that though similarly placed persons like Smt. Chheda Chandan who moved this Court in W.P.(C) No. 5649 of 2012 which was disposed of on 5.5.2016 have been granted benefits however the case of the petitioner has been ignored.

Mr.Dhal, learned Addl. Government Advocate submits that if the petitioner has any grievance he should approach the Special Land Acquisition and Project Director R & R, Lower Suktel Irrigation Project in the district of Bolangir (opposite party No.5) instead of rushing to this Court. 4.

In such background, Mr. Mahanty submits that liberty may be granted to the petitioner to move the Special Land

// 2 // Acquisition and Project Director R & R, Lower Suktel Irrigation Project in the district of Bolangir (opposite party No.5) in the matter by filing a representation and the said opposite party be directed to take a decision on such motion at an early date. 5.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a representation before opposite party No.5 through registered post within a period of two weeks from today. In the event, such a representation is received along with a copy of this order, the opposite party No.5 would do well to take a decision on the same in accordance with law within a period of three months from the date of receipt of such representation and communicate the result of such exercise to the petitioner.

The writ petition is accordingly disposed of. 7.

Urgent certified copy of the order be granted on proper application.
