Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 23.06.2021 in connection with Orkel P.S. Case No.110 of 2021 corresponding to Special G.R. Case No.60 of 2021 pending in the Court of learned Sessions Judge-cum-Special Judge, Malkangiri for the alleged commission of offence under Sections 20(b)(ii)(C)/25 of NDPS Act. 4.

It is alleged that the petitioner and another person were coming in two motor cycles carrying contraband ganja weighing 71 Kg when they were apprehended. It appears that the co-accused person has already been released on bail by order of this Court in BLAPL No. 8173 of 2021.

Considering the submissions, materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and

proper to impose including the condition that he shall furnish cash security of Rs.35,000/- (Rupees Thirty Five Thousand). Further he shall appear before the Court below on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
