Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 16.09.2021 in connection with Balichandrapur P.S. Case No.232 of 2021 corresponding to C.T. Case No.1292 of 2021 pending in the Court of learned J.M.F.C., Chandikhole for the alleged commission of offence under Sections 457/380/411/413/34 of IPC 4.

Considering the nature of submissions made, the materials on record, the period of detention in custody and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case and in case of even a single default, the Court below shall pass appropriate orders to take him to custody again. Further he shall appear before the IIC of Balichandrapur Police Station once in every fortnight for a period of six months and such fact shall be certified by the IIC to the concerned Court once every month.
