This matter is taken up through hybrid arrangement Order No.

(virtual/physical mode).

This is the second journey of the petitioner, who is in custody in connection with Joda P.S. Case No.169 of 2021 corresponding to G.R. Case No.588 of 2021 pending in the court of the learned J.M.F.C., Barbil running for the alleged commission of offence under section 147/ 148/ 341/ 294/ 332/ 232/ 324/325/186/307/395/427/120(B)/ 302 , I.P.C., 7 of the Criminal Law Amendment Act and section 150/151/152 of the Railway Act and section 3 of the Prevention of Damage to Public Property Act in filing this application under section 439, Cr.P.C. for his release on bail.

Heard learned counsel for the Petitioner and learned counsel for the State.

Taking into account the submissions made; further keeping in view the materials on records as those stand against the Petitioner with other surrounding circumstances including the period of detention of the Petitioner in custody and the factum of grant of bail to co-accused similarly situated with this Petitioner; while being inclined to reconsider the prayer for grant of bail to the Petitioner, it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court in seisin of the case with further condition that he will appear in person before the Court in seisin of the case on each date of posting of the case till conclusion of trial and will not indulge himself in any criminal activity.

The BLAPL is accordingly disposed of.
