This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No.29 of 2022 arising out of Jakhapura P.S. Case No.2 of 2022 pending in the Court of learned J.M.F.C. Jajpur Road for commission of offence punishable under Sections 341/294/323/427/452/506 of IPC.

Taking into account the submission of the learned counsel for the State that the petitioner has criminal proclivity in as much as there are five cases of similar nature are pending against him.

Considering all these, this Court is not inclined to exercise its discretion under 438 Cr.P.C.

Accordingly, the ABLAPL stands rejected.
