1. The Petitioner who appears in person reference to a letter dated 2nd July, 2013 written by the Revenue Divisional Commissioner to the Commissioner, Cuttack Municipal Corporation, Cuttack (CMC) on the Petitioner's grievance petition as under:
"From Dr. Arabinda Kumar Padhee, IAS Revenue Divisional Commissioner To The Commissioner, Cuttack Municipal Corporation, Cuttack Sub:Grievance petition of Sri B.K. Sahoo of Machhua Bazar, Cuttack.
Sir, Please find enclosed herewith a petition filed by one Sri B.K. Sahoo of Machhua Bazar, Cuttack in which he has requested to remove encroachment from a public place as
// 2 // identified by the Surveyor of your Corporation. In spite of the encroachment having been clearly delineated, no action has been taken due to extraneous consideration as alleged by the petitioner. You are requested to do the needful immediately."
2. Learned counsel appearing for the CMC states that if time a bound direction is issued to examine the grievance of the Petitioner and to take corrective action it would be complied with.
3. Accordingly, a direction is issued to the Commissioner, CMC to examine the grievance of the Petitioner particularly in the light of the above letter of the RDC and remove the encroachment as pointed out by following the due process of law. The exercise be completed within a period of three months from today.
