Heard the submission of learned counsel for the Petitioner. 2.

This CMP involves rejection of an application under Order 39 Rule 3 of C.P.C. by order dated 05.03.2021. While rejecting such application involving exparte ad interim injunction, it appears the trial Court fixed the case to 19.03.2021 for appearance, objection and hearing of the I.A. involving the Order 39 Rule 1 & 2 of the C.P.C. Petitioner has no information as to what happened to the I.A. involving Order 39 Rule 1 & 2 of the CPC in the meantime.. In the circumstance this Court while declining to entertain such CMP, directs the trial Court, in the event the I.A. involving is not disposed of as of now, attempt for immediate disposal of the application in the trial Court itself, but involving all contestants.
