1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. By order date 18th May, 2022, the Petitioner was granted bail on the condition of furnishing cash security of Rs.10 lakhs in the shape of short term fixed deposit in any Nationalized Bank. By order dated 6th July, 2022 the said order was modified to the extent that instead of cash security of Rs.10 lakhs, the Petitioner shall furnish cash security of Rs.3 lakhs in
// 2 // the shape of short term fixed deposit and further shall pay Rs.2 lakhs by way of equal monthly installments within nine months.
4. It is submitted that pursuant to such order, the Petitioner duly deposited Rs.3 lakhs as fixed deposit and has also paid three installments amounting to Rs.25,000/- each being Rs.75,000/- in all. It is submitted that the Petitioner is unable to furnish remaining amount of Rs.1,25,000/- because of serious financial stringency and therefore, the said condition may be waived.
5. This Court has seen the bona fides of the Petitioner in making the required payment to a great extent. Having regard to the same and considering the submissions, the prayer for modification is allowed. The Petitioner shall not be required to pay any further amount as directed earlier.
6. The I.A. is, accordingly, disposed of.
