Heard Sk.Zafarulla, learned counsel for the petitioner and Mr. K.K.Dash, learned Additional Standing Counsel. 2.

The earlier bail application of the petitioner has been rejected in BLAPL No.7385 of 2020 by order dated 2.2.2021. 3.

This application under Section 439 of Cr.P.C. has been filed by the petitioner who is in custody since 29.08.2020 and facing trial in T.R. Case No.20 of 2020 (arising out of Nabarangpur P.S. Case No.197 of 2020) in the Court of learned Sessions Judge-cum-Special Judge, Nabarangpur for commission of offences punishable under Section 20 (b) (ii) (C) of the N.D.P.S. Act.

As the petitioner has remained in custody for more than two years, on the last date, i.e., 8.9.2022, a report had been called for from the learned Sessions Judge-cum-Special Judge, Nabarangpur regarding status of the T.R. Case No.20 of 2020. The report dated 14.9.2022 received from the District & Sessions Judge, Nabarangpur reveals that

// 2 // out of total 19 charge sheeted witnesses, 8 witnesses have already been examined and the case was posted to 15.9.2022 for further evidence from the side of the prosecution.

Considering the above development in the trial, the BLAPL is disposed of requesting the learned Sessions Judge-cum-Special Judge, Nabarangpur to make an endeavour to dispose of the trial expeditiously, preferably within a period of six months from today. 6.

A copy of this order be sent to learned Sessions Judge-cumSpecial Judge, Nabarangpur. 7.

Urgent certified copy of this order be granted on proper application.
