Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No. 34 of 2021, arising out of Mohana P.S. Case No. 208 of 2021 pending in the Court of learned Special Judge, Gajapati for the alleged commission of offence punishable under Sections-376(2)(n)/506, I.P.C read with Section 6 of POCSO Act. 4.

Perused the 164 Cr.P.C. Statement on record.

Taking into account the 164 Cr.P.C. statement of the victim which has been annexed to the bail application and keeping

in view the age of the petitioner, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail. The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
