This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.158 of 2022, on the files of learned S.D.J.M. Deogarh, arising out of Deogarh P.S. Case No.94 of 2022, under Sections 376(2)(n)/506 of the IPC and is in custody since 07.02.2022.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Deogarh, by order dated 28.03.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.

Considering the tenor of such statement and taking into account that the petitioner is in custody since 07.02.2022, this Court

directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
