W.P (C) No. 17998 of 2013 State of Orissa .....
Petitioner Mr. P.K. Muduli, AGA Vs.
Government of India and another .....
Opposite Parties
CORAM:
DR. JUSTICE B.R. SARANGI MR. JUSTICE S.K. PANIGRAHI
ORDER
04.01.2022 Order No.
03.
This matter is taken up through hybrid mode.
2.
Heard Mr. P.K. Muduli, learned Addl. Government Advocate.
3.
This writ petition has been filed by the State challenging the interim order dated 13.09.2012 passed by the Revisional Authority in Revision Application No.22/(54)/2012-RC-1 in restraining the State from passing any final order in the proceeding initiated against the opposite party no.2 pursuant to the report dated 20.10.2011 of the committee constituted vide notification no.5333/SM dated 08.07.2011.
4.
Although the present writ petition was filed by the State in the year 2013, after 18.03.2015 no effort was made on behalf of the State-petitioner to get the matter listed. Today, when the Court made query about the fact that whether the period of lease granted in favour of opposite party no.2 has been expired or not, most reluctantly, it is answered that the agreement, which was executed in the year 1999, was for 20 years and, as such, the same has already been expired since 2019. Therefore, by efflux of time, the writ petition has become infructuous.
5.
In view of above submission, the writ petition stands disposed of as infructuous.
