1. Heard Mrs. R. Pati, learned counsel for the Appellant-IFFCO TOKIO General Insurance Company Ltd., Mr. J. Sahu, learned counsel for the Respondent Nos.1 & 2-claimants and Ms. S. Das, learned counsel for the Respondent No.5-National Insurance Co. Ltd.
2. It is submitted that in the connected appeals, Viz. MACA Nos.81, 78, 79, 80, 82, 83, 84, 694, 695, 696 and 697 of 2015 arising out of the same accident, this Court remanded back the matter for fresh adjudication to the learned Tribunal with direction to pass reasoned order. Further, all such claim applications are still pending disposal before the learned Tribunal.
3. Keeping in view the submission made at the Bar and taking note of the fact that the other claim applications arising out of same accident are pending disposal as on date, the present appeal is disposed of by sending the matter back to the learned Tribunal
with direction to consider it afresh and pass a reasoned order in accordance with law after giving opportunity of hearing to all the parties as expeditiously as possible, by considering the evidence already adduced on record and such further evidence, if any adduced.
4. The statutory deposit made before this Court with accrued interest thereon shall be refunded to the Appellant-Insurance Company.
5. An urgent certified copy of this order be granted on proper application.
