Since the period of tender has already been over, by efflux of time, the writ petition has become infructuous. 3.

Accordingly, the writ petition is disposed of, as infructuous. However, since the petitioner is claiming for refund of the EMD amount, the petitioner is at liberty to pursue his remedy before the appropriate forum, if he so advised in terms of agreement/DTCN, which is applicable to him.
