The petitioner's prayer for bail was earlier rejected by this Court vide order dated 02.02.2022 in BLAPL No. 547 of 2022 granting liberty to renew his prayer after submission of charge sheet.

Charge sheet has been submitted in the meantime. Hence, the petitioner has renewed his prayer.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 01.12.2021 in connection with Tangi P.S. Case No.467 of 2021 corresponding to G.R. Case No.493 of 2021 pending in the Court of learned N.G.N.-cumJ.M.F.C., Tangi for the alleged commission of offence under Section 394 of IPC.

Having regard to the submissions, materials on record, the period of detention and the fact that the stolen motorcycle and passbook of the informant have already been recovered, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the
matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
