This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.139 of 2019 arising out of Sonepur P.S. Case No. 139 of 2019 corresponding to S.T. Case No. 68 of 2019 on the file of learned Sessions Judge, Sonepur registered for the alleged commission of offence under section 302 of the I.P.C. The petitioner is stated to be in custody since 23.8.2019. 4.

Being aggrieved by the rejection of his application for bail under Section. 439 Cr.P.C. by the learned Sessions Judge, Sonepur by order dated 20.01.2020, the present BLAPL has been filed.

Taking into account the genesis of the offence and the manner in which the assault has taken place, the P.M. report,

period of custody and the age of the petitioner, this Court directs that the petitioner shall be released on bail. Learned court in seisin over the matter shall fix the terms.

Accordingly, the BLAPL stands disposed of.
