Questioning the initiation of the proceeding in Phulbani Town P.S. Case No.167 of 2012 and continuance of the proceeding in G.R. Case No.438 of 2012 pending in the Court of the learned S.D.J.M., Phulbani with a prayer to discharge the present petitioner from the alleged offences punishable under Sections 143, 341, 294, 427 and 149 of the Indian Penal Code, this petition under Section 482 of the Code of Criminal Procedure has been filed.

This matter was on Board on 28.06.2016 and the matter stood adjourned at the behest of the petitioner. Thereafter, when the matter is taken up today, Ms. Anita Sahoo, learned counsel on behalf of Mr. Anirudha Das, learned Advocate, appearing for the petitioner submits that she does not have any instruction in this matter.

Mrs. Saswata Pattnaik, the learned Addl. Government Advocate appearing for the State submits that since the matter

// 2 // is of the year 2015 and by now, trial either has been concluded or the matter ought to have been proceeded substantially. 4.

In view of the aforesaid submission, keeping this matter pending any further will not serve any fruitful purpose. Hence, this CRLMC stands dismissed for non-prosecution. (M.S. Raman) Judge MRS
