This matter is taken up through Hybrid mode.

Petitioner in this writ petition prays for the following reliefs:- "The petitioner therefore prays that Your Lordship may be pleased to consider the fact stated above and admit the Writ Application and after hearing the parties, necessary direction may be issued to Opp. Party No.3 to be allowed the foot path as per agreement as public road. And any other order or orders may be passed as the Hon'ble Court would deem just and proper in the facts and circumstances of the case.

And for this act of kindness the petitioner as in duty bound shall ever pray."

In course of argument, Mr. Pahil, learned counsel for the Petitioner submits that the prayer made in the writ petition is amenable to the jurisdiction of Civil Court. Hence, he prays for withdrawal the writ petition to avail such remedy. 4.

Considering such submission, the writ petition is disposed of as withdrawn.
