1. Admittedly, NTPC is a Central Government Public Sector Undertaking and the reference of any labour dispute has to be made only by the Central Government. In the present matter the impugned references have been made by the orders dated 03.12.2009 of the State Government in I.D. Case Nos.301, 302 and 303 of 2008. Accordingly, they are hereby quashed. This will not prevent the workers' union from pursuing the matter with the Central Government for making a fresh reference, if so permissible in law.
