This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

The writ petition filed by the petitioner involves the following prayer:

"Under the above circumstances, it is therefore humbly prayed that the Hon'ble Court be graciously pleased to direct the Opposite Parties to regularize the service of the petition from 05.02.1994 instead of 21.05.2016 and to grant him all consequential service and financial benefits including the benefit of pension under the OCS (Pension) Rules, 1992 and all other benefits and to grant him all consequential service and financial benefits within a stipulated period as deem fit and proper. And/or pass any other appropriate writ/writs, order/orders, direction/directions in the fitness of the case. And for this act of kindness as in duty bound, the petitioner shall ever pray."

Learned counsel for the Petitioner submits that although Petitioner had initially joined as Peon on 05.02.1994, but his service has been regularized w.e.f. 21.05.2016 by the Opposite Parties. He further

// 2 // submits that he should have been regularized from 05.02.1994 instead of 21.05.2016 and grant all consequential service and financial benefits within a stipulated period as deem fit and proper. It is also submitted that ventilating his grievance, he has filed a representation before the Principal Secretary, Information and Public Relations Department, Odisha, Bhubaneswar-Opposite Party, dated 13.12.2021, on which, no decision has been taken by the Authority as of now.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court is inclined to dispose of the writ petition at the stage of admission directing the Opposite Party to consider the representation of the Petitioner dated 13.12.2021 (Annexure3) strictly in accordance with law, as expeditiously as possible, preferably within a period of two months from the date of production of certified copy of this order. The Opposite Party shall dispose of the same by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter. 6.

With the above direction, the writ petition stands disposed of. 7.
