This matter is taken up through hybrid mode.

Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite party no.4 to take immediate steps as per the clarification and decision of the opposite party no.3 dated 03.03.2022 under Annexure-8 towards release of dues as per measurement and running account bill under Annexure-9, within a stipulated time.

In course of hearing, learned counsel for the petitioner states that the opposite party no.3-Engineer-in-Chief (Civil), Odisha, BBSR has already intimated the opposite party no.5-Chief Engineer, FC & Basin Manager, Lower Mohanadi Basin, BBSR vide letter dated 03.03.2022 under Annexure-8 regarding clarification of payment of contractual dues in favour of "M/s Sri Sai Construction, 'Special' Class contractor" instead of Sri Bhaktaram Purohit, 'Special' Class Contractor, and, therefore, direction may be given to take a decision on the same within a stipulated time, to which learned Additional Government Advocate has no objection.

As agreed by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.5 to consider the letter dated 03.03.2022 vide Annexure-8 and pass appropriate order in accordance with law within a period of two months from the date of production of certified copy this order. 6.

Issue urgent certified copy as per rules.
