1. Mr. T.K. Satapathy, Senior Standing Counsel files a memo of appearance on behalf of the Opposite Parties in Court today, which is taken on record.

2. Heard.

3. We are not inclined to entertain the present petition as the remedy of appeal before the Income Tax Tribunal is available to the Petitioner. The Petitioner is permitted to avail such remedy.

4. If the appeal is filed accompanied with the application for condonation of delay not later than 1st June, 2022 citing the pendency of the present petition as the reason for the delay, the application for condonation of delay shall be considered on merits by

Income Tax Appellate Tribunal in accordance with law. This Court clarifies that it has not expressed any view in the matter.
