This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.228 of 2022, on the files of learned S.D.J.M., Nabarangpur, arising out of Padwa P.S. Case No.28 of 2022, under Sections 341/324/307/34 of the IPC and is in custody since 02.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Nabarangpur by order dated 05.04.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner reliance on the order passed by this Court dated 09.05.2022 in BLAPL No.3215 of 2022 and seeks release inter alia on the ground of parity. 6.
The petitioner has placed on record the statement of the victim/injured Aanta Takri. On perusal of the same, it is seen that the overt act is attributed to Abhi and Akash. This Court had already directed the release of Abhi.

Taking into account the submission of learned counsel for the petitioner and order passed by this Court, it is directed that the petitioner to be released on bail. The learned Court in seisin over the matter to fix the terms.

Additionally, it is directed that the petitioner shall appear once in every 15 days before the jurisdictional Police Station. 9.
Accordingly, the BLAPL stands disposed of.
