This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Spl. G.R. Case No.06 of 2022, on the files of learned Additional Sessions Judge cum Special Court under POCSO Act Nayagarh, arising out of Nuagaon P.S. Case No.12 of 2022, offences under Section 376(2)(n)/ 313/ 506/ 109/ 34 of IPC read with Section 6 of the POCSO act and he is custody since 17.01.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Nayagarh by order dated 07.03.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the tenor of the 164 Cr.P.C. statement and the nature of allegations, this Court directs the petitioner to be

released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
