1. Heard Mr. B.P. Mohanty, learned counsel for the Petitioner and Mr. P.K. Mohanty, learned A.S.C. for the State-Opposite Party No.1.

2. The refusal of the prayer for discharge of the Petitioner for the offence under Section 376, I.P.C. is the subject matter of challenge before this Court in the present petition.

3. Upon hearing both the parties and going through the statement of the victim recorded under Section 164, Cr.P.C. as produced by learned counsel for the Petitioner in course of hearing, I do not find any merit in the present challenge by the petitioner.

4. As such, the CRLMC is dismissed.
