The Petitioner having been implicated in Colliery P.S. Case No.165 of 2022 corresponding to G.R. Case No.766 of 2022 registered for alleged commission of offence under sections 120-B/379, I.P.C. and section 12 of the Mines and Mineral (Prevention of Theft Smuggling Activities) Act, 1989 on the file of the learned S.D.J.M., Talcher has filed this application under section 438 Cr.P.C. for his release on bail in the event of his arrest.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submission and keeping in view the nature of accusation as to the role of the Petitioner as those

// 2 // emanate from the materials on record; I do not find it to be a fit case for grant of anticipatory bail to the Petitioner. 5.

Accordingly, the ABLAPL stands dismissed.
