Seeking a direction to the Commissioner of Excise, Odisha, Cuttack-Opposite Party No.2 to approve proposal for shifting of existing IMFL Restaurant ON shop (Ankita Bar & Restaurant), Hatia under Marshaghai Police Station, Kendrapara to the new site/building over Plot No.861, Khata No.625/21 under Mouza-Hatia in terms of recommendation letter dated 27th June, 2016 of the Collector, Kendrapara, the Petitioner has approached this Court.

This Court issued notice vide order dated 18th November, 2016.

At the time of hearing, Mr. B. Shadangi, counsel for the Petitioner submits that he has no instruction in this regard. 5.

Mr. L. Samantaray, Additional Government Advocate submits that by efflux of time, the writ petition has become infructuous.

In view of the aforesaid submission, the writ petition is disposed of as infructuous.
