1. This matter is taken up through hybrid arrangement.

2. Heard.

3. The petitioner was engaged as a Staff Nurse during the COVID-19 on contractual (daily wage) basis at the rate of Rs.1000/- per day vide engagement order dated 23.03.2020 issued by the Government of Odisha, Health and Family Welfare Department. In the meantime, the petitioner along with some similarly placed persons have been disengaged by office order dated 29.09.2021 issued by the Fakir Mohan Medical College and Hospital, Balasore.

Learned counsel for the petitioner submits that the petitioner has filed representations before the opposite party Nos.2Additional Chief Secretary, Government of Odisha, Health and Family Welfare Department and 4- Superintendent, Fakir Mohan Medical College and Hospital, Balasore to re-engage her against the post of Staff Nurse in Fakir Mohan Medical College and Hospital, Balasore.

5. However, this Court is of the view that the petitioner can apply for the said post as and when advertisement is issued for the said

// 2 // post and such kind of issue cannot be resolved through any representation.

6. In that view of the matter, the petitioner shall apply in response to any advertisement issued for the aforesaid post by the authority and if she is found suitable, she may be appointed.

7. Accordingly, this writ petition is disposed of.

8. Urgent certified copy of this order be granted on proper application.
