Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 10.01.2022 in connection with SFT P.S. Case No.35 of 2021 corresponding to G.R. Case No.29 of 2021 pending in the Court of learned Special Judge-cum-District & Sessions Judge, Cuttack for the alleged commission of offence under Sections 20(c)/29 of NDPS Act.

Though it is submitted that the basis of implication of the petitioner is confessional statement of the co-accused, which is not admissible, yet fact remains that huge quantity of brown sugar was seized, i.e., 1 kg 43 grams. That apart, investigation into the case is in progress. 5.

Having regard to the above facts, I am not inclined to allow the prayer for bail, which is therefore, rejected. 6.

BLAPL is accordingly rejected.
