This matter is taken up through hybrid arrangement (virtual/physical) mode.

The Petitioners having been implicated in Jeypore Sadar P.S. Case No.71 of 2019 corresponding to G.R. Case No.343 of 2019 for alleged commission of offence under section- 448/294/506/171-C/34 of the IPC read with section25/27 of the Arms Act and section-131/132 of the Representation of People Act pending on the file of learned S.D.J.M., Jeypore, have filed this application under section-438 of the Cr.P.C. for their grant of anticipatory bail in the event of their arrest in the above mentioned case.

Heard learned counsel for the Petitioners and learned counsel for the State.

Considering the submissions made and on going through the materials as placed and other surrounding circumstances; while being not inclined to grant anticipatory

// 2 // bail to the Petitioners, this application is disposed of with the observation that when the occasion would so arise before the learned Court in seisin of the case to consider the prayer for grant of regular bail to the Petitioners, the same shall be considered on its own merit; further taking into account all such developments which have taken place in the meantime in their proper perspective and disposed of early in accordance with law, so as to enable the Petitioners to move the next higher forum early in case necessity so arises.

The ABLAPL is accordingly disposed of.

Interim order passed on 30.04.2019 does no more survive.

Issue urgent certified copy as per rules.
