This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 25.01.2022 in connection with Gochhapada P.S. Case No. 74 of 2021 corresponding to C.T. Case No. 61 of 2021 pending in the court of learned Sessions Judge-cum-Special Judge, at Phulbani for the alleged commission of offence under Sections 20(b)(ii)(C) of the NDPS Act.

It is alleged that three persons had stacked seven bags containing contraband ganja weighing more than 3 quintals when they were apprehended by police. One of the said persons was apprehended and two others are said to have fled away. The petitioner was implicated on the basis of the statement of person who was arrested at the spot. Nothing was seized from the exclusive and conscious possession of the petitioner. 5.
Considering the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such
terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition including the condition that he shall appear before the IIC of Gochhapada Police Station on every Sunday at 10.00 A.M. till conclusion of trial and such fact shall be certified by the IIC to the concerned Court once in a month. Further, he shall personally appear before the trial court on each date of posting of the case failing which NBW shall be issued to take him into custody again. 6.
The BLAPL is accordingly disposed of.
