Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 04.03.2022 in connection with Kishorenagar P.S. Case No.147 of 2021 corresponding to G.R. Case No.788 of 2021 pending in the Court of learned S.D.J.M., Athamallik for the alleged commission of offence under Sections 379/511 of IPC read with Sectio n15(2) of Petroleum Act. 4.
It is alleged that the petitioners damaged the main pipe line of Indian Oil Corporation Limited with the intention of committing theft of petroleum product. However, they were prevented from doing so.

Having regard to the submissions made, the materials on record, the period of detention in custody and the fact that except for damaging the pipe line, no other offence was committed by the petitioners, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose
including the condition that they shall personally appear before the trial Court on each date of posting of the case without fail. 6.
BLAPL is accordingly disposed of.
