This Interlocutory Application has been filed by opposite party Order No.

no.3 for modification of the order dated 19.04.2022 passed in W.P.(C).No.9399 of 2022.

Considering the submission through I.A.No.9609 of 2022, this Court finds there is suppression of material fact in obtaining the order of this Court dated 19.04.2022. An attempt is being made with service of copy of the I.A. on learned counsel argued in W.P.(C).No.9399 of 2022, learned counsel declines to appear for the petitioner on the premises that he has no further instruction and further the petitioner has also taken away the brief. This Court finds difficulty in getting into his submission of learned counsel for the petitioner.

In the process, this Court directs issue notice to the petitioner in W.P.(C).No.9399 of 2022 by speed post/ registered post with A.D. fixing a short returnable date requisites for which shall be filed by tomorrow (02.08.2022).

In the meantime, there shall be stay operation of the order dated 19.04.2022 passed in W.P.(C).No.9399 of 2022 till next date . 4.

List this matter on 30.08.2022 along with W.P.(C).No.16787 of 2022. Registry is directed to indicate the name of new counsel, if any,
