1. In view of the judgment of the Supreme Court of India dated 28th March, 2003 in Civil Appeal Nos.6474-6798 of 2017 (State of Orissa v. M/s. Reliance Industries Ltd.), the impugned order of the Orissa Sales Tax Tribunal, Cuttack dated 23rd July, 2009 passed in S.A. No.74(ET) of 2005-06 is hereby set aside.

2. The appeal is allowed accordingly.
