1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 17th September, 2021 in connection with Kesinga P.S. Case No.348/2021 corresponding to C.T. Case No.57/2021 pending in the court of learned Special Judge, Kalahandi, Bhawanipatna for the alleged

// 2 // commission of the offence under Section 20(b)(ii)(C) of N.D.P.S. Act

4. The allegation is that the Petitioner and some other persons were found to be carrying contraband ganja weighing 47 kgs. when they were apprehended by Police. Two of the co-accused persons have been granted bail as per the orders passed by this Court in BLAPL No.9942/2021 and CRLREV No.530 of 2021

5. Having regard to the above facts, the materials on record and the period of detention in custody without commencement of trial, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the conditions that he shall furnish cash security of Rs.50,000/-(Rupees Fifty Thousand), he shall appear before the trial court on each date of posting of the case, failing which it shall be open to the said court to pass necessary orders to take him to custody again and he shall not leave the territorial jurisdiction of the court without obtaining any leave.
