This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special G.R. Case No.30 of 2021, on the files of learned Additional Sessions Judge-cumSpecial Judge, Deogarh arising out of Reamal P.S. Case No.197 of 2021, under Sections 376(DA) of IPC read with Section 4(2), 6 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions-cum-Special Judge, Deogarh, by order dated 04.04.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim, this Court is not inclined to entertain this bail application.

Accordingly, the BLAPL stands disposed of giving liberty to the petitioner to move this Court after the examination of the victim.
