This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Balugaon P.S. Case No.33 of 2021 corresponding to G.R. Case No.44 of 2021 pending in the Court of learned J.M.F.C., Chilika for alleged commission of offences under sections 420, 406, 494, 211, 120-B, 379, 506, 323, 312/34 of the Indian Penal Code.
// 2 // Learned counsel for the State submitted that the case arises out of a complaint petition, which was sent under section 156(3) of Cr.P.C. to the Inspector incharge of Balugaon police station and accordingly, the case was instituted. She further submitted that petitioner no.1 is the wife of the complainant and petitioner nos.2 and 3 are the parents of petitioner no.1.
Considering the nature of accusation against the petitioners and since the case arises out of a matrimonial dispute and the fact that the petitioners have been granted interim protection since 09.04.2021 and there is no material that they have misutilized their liberty, the interim order dated 09.04.2021 is made absolute.
The ABLAPL is accordingly disposed of.
