Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No. 1798 of 2022, arising out of Khandagiri P.S. Case No. 143 of 2022 pending in the Court of learned S.D.J.M., Bhubaneswar for the alleged commission of offence punishable under Sections-341/323/294/506 of the I.P.C.

Being aggrieved by the order dtd. 05.04.2022 passed by the learned Additional Sessions Judge, Bhubaneswar in B.A. No. 460 of 2022 rejecting the order under Section 438 Cr.P.C.. The present ABLAPL has been filed.

Taking into account the nature of allegation, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioners shall be released on bail. The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
