This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

This is an application under Section-438 Cr.P.C for anticipatory bail.

The petitioners are seeking pre-arrest bail in connection with C.T. Case No. 1903 of 2022, arising out of Badagad P.S. Case No. 105 of 2022 pending in the Court of learned S.D.J.M., Bhubaneswar for the alleged commission of offence punishable under Sections-143/341/323/307/395/149/353/332/294 of the I.P.C.

Taking into account the Order dtd. 17.05.2022 in ABLAPL Nos. 3774, 3775, and 3778 of 2022, while being not inclined to consider the prayer for grant of anticipatory bail to the petitioners, this application stands disposed of with an observation that, in the event the petitioners surrender before the Court in seisin of the case and move for their release on bail, the same shall be considered on its own merit and disposed of in accordance with law without being influenced by this order during the first half of the day so as to enable the Petitioners in case necessity so arises, to approach the next higher forum in the second hour for its disposal in course of the day. 6.

Case Diary to be made available to the higher forum if necessary at the cost of the petitioners.

The ABLAPL is disposed of accordingly.
