This matter is taken up through Hybrid Arrangement Order No.
(Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

The present writ petition has been filed by the Petitioner with the following relief:
"It is therefore prayed that considering the above facts and grounds this Hon'ble Court may graciously be pleased to direct the opp. Parties more particularly to the Opp. Party No.2 to take necessary steps for appointment of the present petitioner under rehabilitation assistant scheme, thereby considering her grievance letter/representation under Annexure-7 of this writ petition as early as possible to meet the ends of justice."

It is submitted by learned counsel for the Petitioner that highlighting her grievance, the Petitioner has filed a representation before the Executive Engineer, R.W.S & S. Division, Balasore, Opposite Party No.2, on which, no decision has been taken as yet.
// 2 // Accordingly, a prayer has been made to direct the Opposite Party No.2 to dispose of the said representation expeditiously. 5.
Learned counsel for the State on the other hand submits that he has no objection, if a direction is given to the Authority to consider and dispose of the representation of the Petitioner within a stipulated period of time.

Considering the limited nature of grievance, this Court feels it appropriate to direct the Petitioner to file a fresh representation before the Executive Engineer, R.W.S & S. Division, Balasore, Opposite Party No.2 within a period of two weeks from today. In such event, Opposite Party No.2 shall consider and dispose of the said representation of the Petitioner in accordance with law and taking into consideration the judgment of the Hon'ble Apex Court in the case of State of Madhya Pradesh vs. Ashish Awasthi, reported in 2021(II) OLR (SC) 1072. In such event, the Authority shall consider and dispose of the representation of the Petitioner by passing a speaking and reasoned order within a period of three months from the date of production of certified copy of this order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter.

With the above observation, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
