Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 21.09.2021 in connection with Mudulipada P.S. Case No. 54 of 2021 corresponding to G.R. Case No. 67 of 2021 pending in the court of learned Sessions Judge-cum-Special Judge, Malkangiri for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act. 4.

The petitioner was not named in the FIR but basing on the confessional statement of one accused Hadi Challan, the petitioner was arrested three months after the occurrence. 5.

Considering the above facts as also the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose

including the condition that the petitioner shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
