CORAM:

THE CHIEF JUSTICE JUSTICE R.K.PATTANAIK Order No.

ORDER

15.03.2022 13.

1. Over 10 years now, there has been interim order asking status quo to be maintained in respect of the Petitioner's Deep (lamp) shop. On 1st December, 2015 an order was passed noting that the Temple Administration has decided to construct a rest room for Palia Pujapanda Sevak near the Petitioner's present location and time was granted to the Temple Administration for further instructions on where the present Petitioner's shop could be relocated.

2. Today Mr. Palit informs the Court that the construction of the rest room has been completed and the Petitioner is continuing in the same location.

3. Therefore, it appears now that pursuant to the interim order passed by this Court way back on 23rd December, 2010 i.e.

// 2 // more than 11 years ago status quo in regard to the Petitioner's shop has continued.

4. Consequently, it is directed that in the event the Temple Administration wishes to relocate the Petitioner, it will give him at least 15 days' advance notice informing him of the location of the alternative site so that if the Petitioner has any reservations about such site he can seek appropriate remedies in accordance with law during such notice period. Till then the status quo as of today will continue.

5. The writ petition is disposed of in the above terms. (Dr. S. Muralidhar) Chief Justice (R.K. Pattanaik) Judge KC Bisoi
